Weld County Home Rule Charter Section 14-8

The central issue is Section 14-8 of the Weld County Home Rule Charter. The provision states that certain capital expenditures funded by ad valorem property taxes equal to three mill levy for three years (roughly $177 million) must be submitted to the Weld County voters for approval.
The proposed Justice Center is well above that threshold.
The Weld County Board of County Commissioners maintain that Section 14-8 is a limitation on taxation, not overall project spending, and argues that voter approval is not required if the project is funded without raising property taxes.
A lawsuit has been filed challenging the County's interpretation and seeking an injunction to prevent the Justice Center from moving forward without voter approval.
